Terms of Service

1. Who we are and what this is

Perdura ("the service"), available at perdura.fit, is a fitness tracking application for logging training, body composition, nutrition, sleep and activity, and for planning them. It is run by Eduardo Ventura, an individual based in El Salvador ("we"), whose mailing address for notices is Eduardo Ventura Ventura, SN-214955, 243 Quigley Blvd, Unit E, Global Shopaholics LLC, New Castle, Delaware 19720, United States, and support@perdura.fit. You accept these terms by ticking the box that asks for it before you first use the service. If you do not accept them, do not use the service.

2. Accounts

You sign in with a Google account or with an email address and a password. You are responsible for activity under your account. You must be at least 18 years old to use the service. If we learn that an account belongs to someone younger, we will delete it.

3. Your data

The data you log belongs to you. You give us permission to store it and process it only to run the service for you, as the Privacy Policy and the Consumer Health Data Policy describe. You can export it at any time from Data & privacy (in the account menu) and delete your account and data yourself from Settings → Account (or by contacting support).

What you choose to share in Community stays yours. You let Perdura show it to the members the Privacy Policy describes, for as long as you keep it shared. A routine someone saves as a copy becomes their own routine; removing yours does not remove their copy.

4. Premium: price, renewal and cancelling

The free plan has no charge. Premium is a monthly or yearly subscription. The price is shown on the pricing page and again before you pay.

  • Free trial. The yearly plan starts with a 7-day free trial the first time you subscribe. You give a card at checkout and nothing is charged during the trial. If you cancel before it ends you pay nothing; otherwise the first year is charged when it ends.
  • Renewal. Premium renews automatically at the same price, every month or every year, until you cancel.
  • Cancelling. Cancel any time from Settings → Billing → Manage subscription. Premium then stays until the end of the period you paid for. Deleting your account cancels it at once.
  • Price changes. If the price of your plan goes up, we email you at least 30 days before it applies to you, and you can cancel before it does.
  • If Premium ends. Your data is kept until you delete your account, and you can still export it. The Premium features stay unavailable until you subscribe again.
  • Changes to what a plan includes. We may change what each plan includes. If a change removes something you paid for, we tell you first (by email) and you can cancel and get a refund of the unused part of the current period.

5. Payments, tax and refunds

  • Who sells it. Premium is sold to you by Polar Software, Inc. ("Polar") as the seller of record and our payment provider. Polar charges your card, adds and pays any sales tax or VAT that applies, and sends you the receipt. Your purchase is also covered by Polar's checkout buyer terms. We provide the service itself.
  • 14-day refund. Ask for a refund within 14 days of your first payment for Premium and you get all of it back, with no reason needed. For a renewal, ask within 14 days of the charge and we refund it once per account. Email support@perdura.fit from your account address. Refunds go back to the original payment method through Polar, and end your Premium at the same time. The first-payment refund includes the 14-day right of withdrawal that consumers in the EU and UK have for digital services, so you do not have to give up any right to buy.
  • After that. A period you have already used is not refunded, except where the law says otherwise or we cannot deliver the service. If we end your account without a reason you caused, we refund the rest of the period you paid for.
  • Your rights come first. If Polar's checkout buyer terms and these terms differ on a refund, the one more favourable to you applies. Nothing in this section limits a withdrawal or refund right the law of your country gives you; in El Salvador, the 8-day withdrawal of the Ley de Protección al Consumidor is included in our 14-day refund.
  • Problems with a charge. Write to us first. We fix it, usually with a refund, faster than a card dispute does.

6. Not medical advice

Perdura is a fitness tool, not a medical service. It records what you log and works out estimates from it: calorie and protein targets, next weights and repetitions, body-composition trends. These are automatic calculations from general rules, not advice for your body, and they can be wrong. Perdura does not diagnose, treat or prevent any disease, and nothing in it is medical, nutritional or professional coaching advice. We are not doctors, dietitians or coaches.

Exercise carries a risk of injury. Check with a doctor before you start or change a training or nutrition programme, especially if you have a heart, lung, joint or other medical condition, take medication, are pregnant or have recently given birth, or have had an eating disorder. Warm up, use safety equipment and good form, and stop at once if you feel pain, dizziness, chest discomfort or shortness of breath; get medical help if it does not pass.

Our safeguards are limits, not checks. Before it sets calorie targets, Perdura asks a few health questions, and if any answer is yes it shows no targets; it never plans calories below a floor. These limit what the tool does. They do not mean that a target or a weight is right for you.

Ask Perdura's AI answers are written by an AI model (Claude, by Anthropic); they can be wrong or out of date, are general information and are not advice either. In an emergency, call your local emergency number (911 in El Salvador). You are responsible for how you use Perdura's suggestions, for entering accurate information, and for choosing weights and foods that are safe for you.

7. Acceptable use

  • No attempts to access other users' data beyond the sharing features provided.
  • No abusive load, scraping, probing, or interference with the service.
  • No unlawful use.
  • No entering someone else's personal or health data without their permission, and no shared accounts.
  • No attempts to make Ask Perdura produce harmful content or get around its limits.
  • No uploading content that infringes someone else's rights.
  • In Community, including messages: no harassment, hate, sexual content, threats, impersonation, spam or selling, no messages someone did not want, and nothing that encourages self-harm or disordered eating, in a name, handle, bio, picture, post, photo, comment, message, routine name, playlist title or group.
  • No using Community to collect other members' information.
  • You must be 18 or older to use Messages.
  • Perdura may hide or remove a Community profile, post, photo, comment, message, routine, playlist or group that breaks these terms, may pause or end an account's access to Messages or to Community, and may close an account for severe or repeated abuse.

8. Our content

The software, text, design and exercise guides of Perdura belong to us or to the people who license them to us. You may use them through the service for your own training, and not copy or resell them. If you think something in Perdura infringes your rights, write to support@perdura.fit with the work, where it appears and how to reach you; we reply within 10 business days.

9. Availability and liability

The service is provided "as is", without promises that it will always be available or free of errors. We recommend keeping periodic JSON exports of your data. To the maximum extent the law allows, our liability to you for anything connected with the service is limited to the greater of the amount you paid for it in the twelve months before the claim and USD 50. Nothing in these terms excludes or limits liability that the law does not allow us to limit (for example for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct) or any right you have under mandatory consumer or data protection law where you live, including El Salvador's Ley de Protección al Consumidor.

10. Ending your use

You may stop using the service at any time. We may suspend or end accounts that break these terms, and we will tell you why when we can. Upon account deletion your data is removed as described in the Privacy Policy.

11. Changes to these terms

We may update these terms. When a change matters, we ask you to read and agree again in your account before you continue, and the date at the top changes. If you do not agree, you can export your data and delete your account.

12. Law and disputes

The laws of El Salvador govern these terms, except that mandatory consumer protection rules of the country where you live still apply to you. Write to us first at support@perdura.fit; most problems end there. If we cannot agree, the courts of El Salvador decide, without taking away your right to go to the courts where you live if the law gives you that right. You can also complain about a purchase to El Salvador's Defensoría del Consumidor, about your personal data to its Agencia de Ciberseguridad del Estado, or to the authority of the country where you live.
